Service Description

Obsidian is a private document analysis platform operated by CYVERRA LTD, a company registered in England and Wales (Company No 17172266) with its registered office at Dept 6723, 196 High Road, Wood Green, London, N22 8HH, United Kingdom. The platform provides dedicated GPU instances running open-source AI models for secure document analysis. Each vault runs on a GPU dedicated to it, rented from independent hosts on a third-party GPU marketplace, where your documents are processed by open-source models. Obsidian is available to both individuals and organizations (including businesses, law firms, and other entities) acting through an authorized individual account holder; where you use Obsidian on behalf of an organization, you confirm you are authorized to bind that organization to these Terms.

Accounts

To use Obsidian, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials. You must notify us immediately if you become aware of any unauthorized use of your account. You must be at least 18 years old to create an account. We do not open accounts for individuals or entities located in, resident in, or organized under the laws of Russia, Belarus, Iran, North Korea, Syria or Cuba. We refuse a sign-up from an IP address in those countries, with one of them as the declared country, or with an email address on their national domains (.ru, .by, .ir, .kp, .sy, .cu), and we refuse card payments with a billing address there; we may suspend or terminate an account found to violate this restriction.

Acceptable Use

You agree not to use Obsidian to:

• Process, upload, or analyze illegal content or content that violates the rights of others.
• Attempt to gain unauthorized access to other users' vaults, accounts, or data.
• Interfere with, disrupt, or overload the platform's infrastructure or other users' access.
• Reverse engineer, decompile, or disassemble the platform (excluding open-source components).
• Resell or redistribute access to the platform without authorization.
• Use the platform for any purpose that violates applicable law.

Payment Terms

Obsidian uses a prepaid balance model. You add credit to your account using Visa or Mastercard, in any amount from $1.13 to $22,480.00 per top-up in the currency you choose (€1 to €20,000, or its equivalent in the currency you pick at the day's rate). GPU time is billed per minute at the hourly rate for your chosen model tier. There are no subscriptions, recurring charges, or minimum commitments. At zero balance you cannot start or resume a vault, and a running vault is paused automatically when your balance can no longer cover the next minute, so your balance does not go below zero. Intellectual Property

You retain all rights to the documents you upload and the outputs generated within your vaults. Obsidian does not claim any ownership or license to your content. The Obsidian platform, including its design, code, and branding, is the intellectual property of CYVERRA LTD and is protected by applicable intellectual property laws.

Data and Privacy

Our servers relay your uploads to your vault's GPU instance without storing them, and all document processing occurs on that instance. When chat saving is on (the default), your questions and the AI's replies are stored in our database. When you destroy a vault, its GPU instance and disk are deleted, and so is its saved chat history. For full details about how we handle your information, see our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, CYVERRA LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use the platform. Our total liability shall not exceed the amount you have paid to us in the 12 months preceding the claim.

Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind. We do not guarantee that AI-generated outputs will be accurate, complete, or suitable for any particular purpose. You are responsible for verifying the accuracy of any AI-generated content before relying on it for professional, legal, medical, financial, or other decisions.

Termination

We may suspend or terminate your account at any time if you violate these terms. You may close your account at any time from Settings → Privacy & Data once all your vaults are destroyed, or by contacting us at support@obsidian.expert. Upon termination, vaults are destroyed (deleting their GPU instances and disks) and your profile is anonymised; records are kept as described in our Privacy Policy. If you close your account voluntarily, any unused prepaid balance is refundable in accordance with our Refund Policy. If we suspend or terminate your account for cause — a violation of these terms or our Acceptable Use policy — any unused prepaid balance may be forfeited to the extent permitted by applicable law. Consumed compute time is non-refundable in all cases. Sections relating to intellectual property, limitation of liability, and disclaimer of warranties survive termination.

Changes to These Terms

We may update these Terms of Service from time to time. We post every change on this page and update the date at the top; for a material change we also tell you by email or by a notice on the platform before it takes effect. Your continued use of the platform after changes take effect constitutes acceptance of the updated terms.

Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the platform shall be resolved exclusively in the courts of England and Wales, save that either party may seek injunctive relief in any jurisdiction to protect its confidential information or intellectual property.
